You may not use this website, or the information provided at this website for any illegal uses

or in any manner inconsistent with the Terms. You agree to use this website solely for your personal use and benefit or that of your organization, and not for resale or other transfer to, or use by or for the benefit of, any other person or entity. You agree not to use, transfer, distribute or dispose of any information contained in this website in any manner that could compete with the business of OFZA. You acquire no rights or licenses in or to the website and materials contained therein. OFZA prohibits caching this website, unauthorized hypertext links to this website, and the framing of any materials available through this website.

LIMITATION OF USERS

Respective Governing bodies enforce regulations and financial sanctions that prohibit transactions with certain high-risk regions. OFZA does not permit access to its website or mobile application in any jurisdiction that is subject to the sanction’s programs administered by the UAE Government and other governing bodies. Customers attempting to log in from one of these prohibited regions will be prevented from accessing our services. Should a customer attempt to access the OFZA website or mobile application, access will be denied, and the customer will receive a pop-up message informing the customer that he/she is attempting to log in from a prohibited region. The restricted person to use our platform includes person involved in any trade embargoes or economic sanctions, terrorist or corrupt foreign officials list (such as the United Nations Security Council Sanctions List,  issued by a government agency including the list of specially designated nationals maintained by the office of foreign assets control of the U.S. Department of the Treasury (OFAC), or the denied persons or entity list of the U.S. Department of Commerce), or by the United Kingdom, European Union, Canada) tor (b) resides, or is established, or has operations in jurisdictions of USA, UK, Canada. It is solely operated in the jurisdiction of UAE.

Please be aware that access to your OFZA account will be restricted if you are in the prohibited region. If you reside in a non-prohibited region, your access will be restored once you log in from any non-prohibited region and, if necessary, verify your identity.

If, however, OFZA concludes that you reside in a prohibited region or are violating applicable sanctions in any way, your account will be closed and OFZA will take any other actions required by law.

If you are under the age of 18 (or a lower age determined by the laws of your country), you must obtain consent from a parent or legal guardian before providing your personal data and to use our platform.

DATA PROTECTION & PRIVACY DISCLAIMER

Personal Data. You acknowledge that we may process personal data in relation to you (if you are an individual), and personal data that you have provided or in the future provide to us in relation to your employees and other associated individuals, in connection with this Agreement, or the OFZA Services. Accordingly, you represent and warrant that: (i) your disclosure to us of any personal data relating to individuals other than yourself was or will be made in accordance with all applicable data protection and data privacy laws, and such data are accurate, up to date and relevant when disclosed; (ii) before providing any such personal data to us, you have read and understood our Privacy Policy, and, in the case of personal data relating to an individual other than yourself, have (or will at the time of disclosure have) provided a copy of that Privacy Policy (as amended from time to time), to that individual; and (iii) if from time to time we provide you with a replacement version of the Privacy Policy, you will promptly read that notice and provide a copy to any individual whose personal data you have provided to us.

Although  we shall obtain information and data available on the website (the "information") from sources that OFZA considers reliable, the information is provided on an "as is" basis and neither OFZA, its affiliates, any of its or their direct or indirect information providers nor any other third- party involved in, or related to, compiling, computing or creating any of the information (collectively, the "OFZA parties") warrants or guarantees the originality, accuracy and/or the completeness of any of the information or the results to be obtained by any use thereof and none of the OFZA parties shall have any liability to any person or entity for any errors, omissions or interruptions of or in connection with the information. Further, none of the OFZA parties makes any express or implied warranties of any kind and the OFZA parties hereby expressly disclaim all warranties (including, without limitation and for purposes of example only, all warranties of title, sequence, availability, originality, accuracy, completeness, timeliness, non- infringement, merchantability and fitness for a particular purpose and all implied warranties arising from trade usage, course of dealing and course of performance) with respect to the information, without limiting the generality of any of the foregoing, in no event shall any of the OFZA parties have any liability to any person or entity for any damages, whether direct, indirect, special, incidental, punitive, consequential (including, without limitation, loss of use, lost profits or revenues or any other economic loss), even if it might have anticipated, or was advised or notified of, the possibility of such damages.

INDEMNIFICATION

You agree, at your own expense, to indemnify, defend and hold harmless OFZA and its employees, representatives, suppliers and agents, against any claim, suit, action or other proceeding, to the extent based on or arising in connection with your use of this website, or any links on this website, including, but not limited to your use or someone using your computer's use of this website. You agree to pay any and all costs, damages and expenses (including reasonable attorney’s fees) and costs awarded against or incurred by or in connection with or arising from any such claim, suit, action or proceeding.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the UAE, without giving effect to conflicts- of- law principles thereof. You agree to submit to the personal jurisdiction of the courts located in Dubai, UAE with respect to any legal proceedings arising out of this agreement and waive any objection to the propriety or convenience of venue in such courts. If any provision of the Terms is found by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be enforced to the maximum extent permissible and the other provisions of the Terms shall remain in full force and effect. If you choose to access this website from outside the UAE, you are responsible for compliance with foreign and local laws.
